Legal Issues Re: Fulton County's Vaccine Mandate
FOX 5 Atlanta (August 2021) – Mr. Fidlon appeared on FOX 5 Atlanta and provided important legal insights on Fulton County’s potential COVID-19 vaccine mandate for its employees. Following reports showing a steady increase in COVID-19 cases in the summer of 2021, the Chairman of Fulton County’s Board of Commissioners announced that the Board will consider mandating that all Fulton County employees receive a COVID-19 vaccine, or face termination. Mr. Fidlon confirmed that, under the latest guidance from the Equal Employment Opportunity Commission (EEOC), it is legally permissible for public and private sector employers to require employees to receive the COVID-19 vaccine. He added that, while vaccine mandates are legal, employers must provide reasonable accommodations for employees who are unable to receive the vaccine due to a disability or a sincerely held religious belief. These accommodations could include alternative measures like regular COVID testing or the option to work remotely, depending on the circumstances.
