We are very experienced in the fast-growing area of wage/hour and overtime disputes. These cases are brought under the Fair Labor Standards Act (FLSA), which is the federal law that guarantees covered, non-exempt employees be paid at least minimum wage, and receive overtime pay for working more than 40 hours per week. Many employers do not fully understand their obligations under the FLSA, and as a result, attempt to avoid its requirements by misclassifying their employees as independent contractors, failing to pay them for all hours worked, requiring them to work “off the clock”, adopting pay plans that do not properly calculate overtime pay, and improperly docking employees’ pay.
