Legal Update - DOL Rule Increasing Minimum Salary Thresholds for Overtime ExemptionsIn April 2024, the U.S. Department of Labor issued a rule raising the salary thresholds for exempt employees under the FLSA, but two federal courts in Texas struck it down, leaving the prior $684 per week minimum in effect while appeals are pending. Employers and employees should continue following current rules and monitor further developments.
The Pregnant Workers Fairness Act (PWFA) took effect on June 27, 2023, with the EEOC’s final regulations effective June 18, 2024. The law requires employers with 15 or more employees to provide reasonable accommodations for workers affected by pregnancy, childbirth, or related conditions - similar to ADA protections. Employers must engage in an interactive process and cannot require leave if another accommodation is available.
Legal Update - FTC Non-compete BanIn April 2023, the FTC adopted a nationwide ban on non-compete agreements set to take effect in September 2024, but a Texas federal court struck down the rule, finding the FTC exceeded its authority. With the ruling still in effect and the government pausing its appeal, state laws continue to govern non-compete agreements, and existing contracts remain enforceable under applicable state law.
